1 Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the TestNest mobile application and related services (collectively, the "Service"), operated by TestNest ("we", "our", or "us").

2 Description of the Service

TestNest is a community platform designed to help Android app developers satisfy Google Play Store's closed-testing requirements. The Service enables:

• App Listings – submitting your Android app for reciprocal testing by other developers.
• Test Swaps – requesting to test another developer's app in exchange for having your own app tested.
• Proof Submissions – uploading screenshots as evidence of completed testing.
• In-App Messaging – communicating with your swap partner during an active test swap.
• 14-Day Testing Timeline – tracking daily testing progress over the required period.
• Notifications – push and in-app alerts for swap activity, messages, and proof reviews.

3 Account Registration

You must sign in with a valid Google account to use TestNest. By connecting your Google account you:

• Represent that the account belongs to you and that you are authorised to use it.
• Agree that the display name, email, and profile photo from your Google account will be stored and shown to other users in the context of test swaps.
• Are responsible for all activity that occurs under your account.

You may not create multiple accounts to circumvent bans, inflate testing statistics, or game the swap system.

4 Test Swap Rules and Obligations

The integrity of the TestNest platform depends on honest participation. By using the swap system you agree to:

• Only submit apps that are genuinely published on Google Play (or at minimum in active closed testing) and belong to you.
• Actually install and use any app you agree to test for the full required period (minimum 14 days and at least 120 seconds of active use per daily session unless otherwise specified).
• Submit authentic, unaltered screenshots that genuinely represent your testing activity. Fabricated or edited proof images are strictly prohibited.
• Provide timely and honest proof reviews. You must not approve proof that does not meet the requirements, nor reject valid proof in bad faith.
• Not request or conduct self-testing (you cannot be both the requester and the app owner in a swap).
• Communicate respectfully with other users via the in-app messaging system.

5 User Content

5.1 Your Content. You retain ownership of screenshots, app icons, descriptions, and messages you submit ("User Content"). By submitting User Content you grant TestNest a non-exclusive, royalty-free, worldwide licence to store, display, and transmit that content solely to operate and improve the Service.

5.2 Prohibited Content. You must not submit User Content that:

• Is false, misleading, or fabricated (including fake proof screenshots).
• Infringes the intellectual property rights of any third party.
• Contains malware, viruses, or any harmful code.
• Is sexually explicit, hateful, harassing, or otherwise unlawful.
• Promotes apps that violate Google Play policies or any applicable law.

5.3 Content Removal. We reserve the right to remove any User Content that violates these Terms without prior notice.

6 App Submissions

When you submit an app to the TestNest marketplace you represent and warrant that:

• You are the developer or authorised representative of the submitted app.
• The app complies with Google Play Developer Program Policies.
• The app does not contain malware, spyware, or other harmful functionality.
• The provided package name, Play Store URL, and description accurately describe the app.

We reserve the right to remove any app listing that we reasonably believe violates these Terms or applicable law.

7 Advertising

TestNest displays advertisements powered by Google AdMob. Ads may be personalised based on your advertising ID / IDFA, subject to the permissions you grant. We do not control the content of third-party advertisements. You agree not to use automated tools or scripts to fraudulently click or interact with ads.

8 Acceptable Use Policy

You agree not to:

• Use the Service to harass, threaten, or harm other users.
• Reverse-engineer, decompile, or attempt to extract the source code of the app.
• Scrape, crawl, or automatically access any part of the Service without our written consent.
• Attempt to gain unauthorised access to other users' accounts or Firebase infrastructure.
• Use the Service in any way that could disable, overburden, or impair its operation.
• Circumvent, disable, or interfere with security-related features of the Service.

9 Intellectual Property

All rights, title, and interest in and to the TestNest application (excluding User Content), including its design, code, trademarks, and logos, are and will remain the exclusive property of TestNest. These Terms do not grant you any right to use our trademarks, logos, or brand features.

10 Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, error-free, or secure at all times.
• Completing test swaps through TestNest will guarantee eligibility for Google Play Store production launch. You are responsible for meeting Google's requirements independently.
• App metadata fetched from Google Play is accurate or up-to-date.

11 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TESTNEST AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO USE THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $10 USD.

12 Indemnification

You agree to indemnify, defend, and hold harmless TestNest and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.

13 Termination

We may suspend or terminate your account at any time, with or without cause or notice, if we believe you have violated these Terms or for any other legitimate business reason.

You may delete your account at any time from within the app. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination will survive.

14 Changes to These Terms

We may revise these Terms at any time. When we make material changes, we will update the "Last updated" date and notify you within the app. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service and delete your account.

15 Governing Law

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in India.
